These Terms of Service govern the use of the Alles Gut app and related services. By registering and using the app, you accept these terms.
1. Scope and Contract Formation
These terms apply to all users of the Alles Gut app. The contract is formed upon successful registration. Alles Gut is an app for regular life signs (check-ins). Users can check in at self-selected intervals. If a check-in is missed, the registered emergency contacts are automatically notified by email.
2. Requirements for Use
The following requirements apply for using Alles Gut:
- Minimum age of 16 years (minors require parental consent)
- Valid email address or phone number for verification
- Smartphone with iOS or Android operating system
- Internet connection for using core features
3. Service Description and Costs
The basic features of Alles Gut are free to use. These include: check-in function, up to 5 emergency contacts, push notifications, and email notifications to contacts. We reserve the right to offer paid premium features in the future. These will be clearly marked and require separate consent.
4. User Responsibilities
As a user, you are responsible for:
- Providing correct and current data during registration
- Obtaining explicit consent from your emergency contacts before adding them
- Regularly performing check-ins according to your chosen interval
- Keeping your login credentials secure
- Complying with applicable laws when using the service
5. Limitation of Liability
Alles Gut is a communication tool and not a substitute for professional emergency services (911, 112). We accept no liability for:
- Delayed, undelivered, or incorrect notifications due to technical issues, network outages, or server problems
- Actions or omissions of your emergency contacts after receiving a notification
- Damages arising from use or non-use of the app, unless caused by intentional or grossly negligent conduct on our part
- Data loss due to device defects or operating system updates
- Content or actions of third parties
6. Availability and Maintenance
We strive for high service availability but cannot guarantee 100% uptime. Planned maintenance will be announced in advance when possible. In case of unplanned outages, we work to restore service as quickly as possible.
7. Changes to Terms
We reserve the right to change these terms with reasonable notice. Significant changes will be announced in the app at least 14 days before taking effect. Continued use after the changes take effect constitutes acceptance of the new terms.
8. Termination and Account Deletion
You can delete your account at any time without giving reasons in the app settings. All your data will be permanently removed. We reserve the right to suspend or delete accounts for serious violations of these terms.
9. Final Provisions
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. If individual provisions are invalid, the validity of the remaining provisions remains unaffected. Place of jurisdiction for merchants is Germany.
